Delivery
Timing Method
Upon receiving payment, booth space will be reserved in the
name/company under which it was registered. Single booth payment
entitles exhibitor to a 6 foot wide by 3 foot deep tabletop
display. The Exhibits will be held on Thursday March 15th,
2007 throughout the day. Booth Space is limited and will be
assigned on a first-come first-served basis. All inquiries
and payment must be submitted by December 1, 2006 in order
to secure a booth.
Conditions of Sale and Payment Terms.
Payment terms are within MatureHealth Communications LLC (MHC)/Managed
Health Care Associates, Inc. (MHA) sole discretion, and, unless
otherwise agreed to by MHA payment must be made at the time
of purchase. If we offer or accept any other form of payment,
you hereby agree to all restrictions, terms and conditions
associated with such additional form of payment.
Methods of Payment, Credit Card Terms and Taxes.
Preferred method of payment is check. Other options include
VISA, MasterCard and American Express (Your order is subject
to cancellation by MatureHealth Communications LLC, Managed
Health Care Associates, Inc, at their discretion.)
To purchase any goods and/or services on our Site, you must
(a) be at least eighteen (18) years of age or the applicable
state age of majority, (b) be a natural person (no corporations,
partnerships or other legal entities), and (c) be a resident
in the 50 states of the United States of America, exclusive
of its commonwealths, territories and possessions ("United
States"). Prior to the purchase of any goods or services on
our Site, you must provide us with a valid credit card number
and associated payment information including all of the following:
(i) your name as it appears on the card, (ii) your credit
card number, (iii) the credit card type, (iv) the date of
expiration and (v) any activation numbers or codes needed
to charge your card. By submitting that information to us,
you hereby agree that you authorize us to charge your card
at our convenience.
Your card issuer agreement governs your use of your designated
card, and you must refer to that agreement and not this Terms
of Use to determine your rights and liabilities as a cardholder.
YOU, AND NOT MATUREHEALTH COMMUNICATIONS LLC AND ITS AFFILIATES,
ARE RESPONSIBLE FOR PAYING ANY UNAUTHORIZED AMOUNTS BILLED
TO YOUR CREDIT CARD BY A THIRD PARTY. You agree to pay all
fees and charges incurred in connection with your purchases
(including any applicable taxes) at the rates in effect when
the charges were incurred. Unless you notify MatureHealth
Communications LLC of any discrepancies within sixty (60)
days after they first appear on your credit card statement,
you agree that they will be deemed accepted by you for all
purposes. If MatureHealth Communications LLC does not receive
payment from your credit card issuer or its agent, you agree
to pay all amounts due upon demand by MatureHealth Communications
or Managed Health Care Associates, Inc., or its affiliates.
You are responsible for paying any governmental taxes imposed
on your purchases, including, but not limited to, sales, use
or value-added taxes.
Order Acceptance Policy.
Your receipt of an electronic or other form of order confirmation
signifies our acceptance of your order.
Your order will be deemed accepted by MatureHealth Communications
upon completion of fields filled out on payment page that
you have ordered. We may require additional verifications
or information before accepting any order.
Cancellation/Refund Policy
The final payment of booth fee is due on or before December
1, 2006. Should Exhibitor fail to comply with this rule, MatureHealth
Communications or Managed Health Care Associates, Inc. has
full authority to cancel any or all booth space assigned to
Exhibitor. Failure to submit final payment by December 1,
2006 will risk loss of booth reservation and deposit.
Withdrawal
Withdrawal by Exhibitor must be sent to MHA by written notice.
If Exhibitor provides written notice to MHA prior to October
1, 2006, MHA will refund 50% of the fee paid to MatureHealth
Communications or Managed Health Care Associates, Inc.. Any
Exhibitor who withdraws between October 1, 2006 and December
1, 2006 will be refunded 25% of the fee paid to MHA. No refund
will be given for withdrawals made after December 2, 2006.
Termination of Meeting and Exhibit Should the premises in
which MHA's 4th Annual Business Summit is to be held become,
in sole judgment of MHA, unfit for occupancy, or should the
Meeting and Exhibition be materially interfered with by reason
of action of the elements, strike, picketing, boycott, embargo,
injunction, war, riot, emergency declared by a government
agency, or other act beyond the control of MHA and its affiliates,
the Application and Contract may be terminated by MatureHealth
Communications or Managed Health Care Associates, Inc. Exhibitor
agrees that MHA and its affiliates shall not be liable for
damages or loss sustained or incurred by the Exhibitor as
a result of such termination. In the event of such termination,
the Exhibitor expressly releases and shall hold harmless MHA
and its affiliates of and from all claims for damages or loss,
and agrees that MHA and its affiliates shall have no obligations
or liability in connection with such termination except to
refund to Exhibitor a prorated share of the aggregate amount
received by MatureHealth Communications or Managed Health
Care Associates, Inc. (as rental for exhibit spaces for said
Exhibit), after deducting all costs and expenses in conjunction
with such Exhibit, including a reasonable reserve for claims.
